NEWS - "Counsel can't withdraw from Toyota case"

NEW YORK, March 12 (Reuters) - A Long Island judge has denied a bid by an attorney to withdraw from a lawsuit over unintended acceleration in a Toyota Motor Corp. vehicle.

In denying the motion by plaintiff Maria Kerins' counsel, Nassau County Supreme Court Justice Stephen Bucaria said he had concerns about possible spoliation of the car's "black box," which is used to record information before, during and after a crash.

Bucaria said in a brief order issued Monday that he would reconsider the motion after he received "proper papers, including an affirmation as to the circumstances surrounding the removal of the event data recorder" from the plaintiff's car.
